Terms of Service

By accessing or using the Kreativly.ai platform ("Service"), you agree to be bound by these Terms of Service ("Terms"). If you do not agree to these Terms, you may not use the Service.

These Terms constitute a legally binding agreement between you and Kreativly AI ("Kreativly," "we," "us," or "our").

Kreativly is an ad creative intelligence platform that helps direct-to-consumer (D2C) brands analyze, diagnose, and optimize their Meta (Facebook/Instagram) advertising creatives. The Service includes: ad performance analytics and dashboards, creative health scoring and diagnosis, AI-powered recommendations and predictions, creative scoring for pre-launch evaluation, and campaign performance tracking.

To use the Service, you must create an account using our authentication provider (Clerk). You agree to: provide accurate and complete registration information, maintain the security of your account credentials, notify us immediately of any unauthorized access, and accept responsibility for all activity under your account.

You must be at least 18 years old to create an account.

The Service requires connection to your Meta (Facebook) advertising account. By connecting your Meta account, you: authorize Kreativly to access your advertising data through the Meta Marketing API, confirm you have authority to grant this access for the ad accounts you connect, understand that disconnecting will stop data access but previously synced data remains until you request deletion, and acknowledge that our access is subject to Meta Platform Terms.

You agree not to: use the Service for any illegal purpose, attempt to reverse-engineer or decompile the Service, share your account credentials with unauthorized parties, use automated tools to scrape or extract data from the Service, interfere with the Service's infrastructure, use the Service to compete directly with Kreativly, or misrepresent your identity or authority over connected ad accounts.

Your use of the Service is also governed by our Privacy Policy, which describes how we collect, use, and protect your data. By using the Service, you consent to the data practices described in the Privacy Policy.

The Service, including its design, code, algorithms, AI models, and content, is owned by Kreativly AI and protected by intellectual property laws. You retain ownership of your advertising data and creative assets. We claim no ownership over your Meta advertising content.

You grant Kreativly a limited, non-exclusive license to process your data solely for providing the Service.

The Service uses artificial intelligence to generate insights, scores, recommendations, and analysis. You acknowledge that: AI-generated content is provided for informational purposes and should not be the sole basis for advertising decisions, AI predictions are estimates and not guarantees of future performance, creative scores and diagnoses are relative to your account benchmarks and may vary, and Kreativly is not responsible for advertising outcomes based on AI recommendations.

We strive to maintain high availability but do not guarantee uninterrupted access. The Service may be temporarily unavailable due to: scheduled maintenance (with advance notice when possible), Meta API changes or outages, infrastructure provider issues, or force majeure events.

We will make reasonable efforts to minimize downtime and communicate disruptions.

The Service is currently offered free during the beta period. When pricing is introduced: we will provide advance notice of at least 30 days, existing beta users may receive preferential terms, payment terms will be clearly communicated, and you may cancel before paid plans take effect.

To the maximum extent permitted by law: Kreativly is provided "as is" without warranties of any kind, we are not liable for indirect, incidental, or consequential damages, our total liability shall not exceed the amount you paid for the Service in the 12 months prior to the claim, and we are not responsible for losses caused by Meta API changes, data inaccuracies from Meta, or third-party service failures.

You agree to indemnify and hold harmless Kreativly and its team from any claims, losses, or damages arising from: your use of the Service, violation of these Terms, infringement of any third party's rights, and your advertising content or business practices.

Either party may terminate this agreement at any time. You may terminate by: disconnecting your Meta account and deleting your Kreativly account. We may terminate or suspend your access if: you violate these Terms, your use poses a security risk, or we discontinue the Service (with reasonable notice).

Upon termination, your right to use the Service ceases. You may request deletion of your data as described in our Privacy Policy.

We may update these Terms periodically. Material changes will be communicated via email or platform notification at least 15 days in advance. Continued use after changes take effect constitutes acceptance.

Any disputes will be resolved through: informal negotiation first (30-day period), followed by binding arbitration if negotiation fails. These Terms are governed by the laws of India. The courts of Bangalore, India shall have jurisdiction for any matters not subject to arbitration.

The Service integrates with third-party services including Meta, Clerk, and Google AI. We are not responsible for the terms, policies, or availability of third-party services. Your use of connected services is subject to their respective terms.

If any provision of these Terms is found unenforceable, the remaining provisions continue in full effect. The unenforceable provision will be modified to the minimum extent necessary.
